Few questions:
1. Form i821 : part 2 -4 alien registration number :- as an f1 I believe we don't have it right ? So leave it blank?
2. For i821: part 2- 25 b : again as student I think it's DS on i94. What date do we put on that or leave it blank ?
3. For i821 : part 4 - 1 b. I have entered the United States on the following date and have resided in the states since that time :- do we put last date of arrival to states on it or the date when we first arrived to US? To make it more clear say I came to US in 2008 and went back in 2010 for a month vacation and came back again in 2010. So should I use 2010 or 2008 ?

4. Form I-764 : 16- eligibility category : I believe it's c19 but still want to make sure .
Thanks in advance for anyone input.

looks a lot tricky now than expected. read on the USCIS website that cannot move to other status like F1 or H1 after or before TPS is about to expire. so looks like only helpful for those who have been out of status. Even for those out of status, cannot go back to F1 when TPS about to expire. So a relief for just a short period of time? Jati bujhdai gayo, tetti befaida tha hudai cha. anybody knows about it?

This is by Barbara Marcouiller, a lawyer in Avvo

link is here:

It's a bit tricky. TPS doesn't give you an actual status, but protects you from being returned to your country temporarily, and allows you to work in the U.S. in the meantime. it does not allow you to change status. Here's the tricky part. You absolutely must register for TPS during the initial authorized registration period, and then extend during the designated extension periods. EXCEPT, so long as you are maintaining lawful non-immigrant status, you will be allowed to register for TPS late (outside the initial registration period) if you apply in less than 60 days after your current status is no longer valid. So, you might think about maintaining the F-1 status in case you'd like to change to H-1B or something else later, and if not, then apply for TPS.

@chulbul, USCIS does not recognize Nepalese citizenship certificate. The way you prove your nationality as Nepalese is from Passport and/or birth certificate.

@Trope

1) am i eligible to file?
Yes, you are eligible to file.
2) say if i am eligible and if i apply now I am pretty sure i wont get any notice from USCIS before my departure date so what happens to my status?
AFter you apply, till you get TPS approval, your stay is considered legal regardless of how you are staying.
3) will i b considered illegal if dont get any response before my departure date?
No, the reason USCIS allowed you to apply for TPS is you need to leave US coz of expiring visa but you cannot because of the condition of Nepal. It might take few months for processing during which your stay is considered legal.
4) i have a return ticket and dont know what to do either to overstay or leave?
You think you and your family back home will benefit by staying here, just stay or else leave.
5) on 861 it asks for any place resided other then USA,do i need to mention even it was a travel..
No, place resided means you lived on that place not travel.

@ Torpe and ny2
One of the clause is that you need to prove your continuous residency in US. I don't know how it applies to those who are in US in B1/B2 visa.

That lawyer has definitely no idea about TPS.
Unless some lawyer contradict me with solid proof, my understanding which is true is...
TPS is designed for those whose visas are expiring soon but not able to go to own country because of the situation of the country.
If your visitor visa/status/I-94 duration of status is valid till USCIS receives your TPS application and your visa/status expires before TPS approval, your stay in US during TPS processing will not be considered an unlawful.
If your visitor visa/status has expired before USCIS receives your TPS application and you overstayed, only the days from visa expiry to USCIS reciept date will be considered as unlawful presence.
Definitely if TPS is denied, then your presence will be considered unlawful from the day your visa/status expired.
Even for people entering US illegally, if their TPS is approved, their presence in US is considered legal from the day USCIS receives the TPS application
