A Nepalese royal family member who was delivering a takeaway Indian meal has been accused of raping a sleeping householder, a Sydney court has been told.

Amit Hamal, 21, of Marrickville, appeared in Waverley Local Court on Tuesday charged with having sexual intercourse without the woman's consent on July 16 at a Rose Bay house in Sydney's east.

In unsuccessfully applying for bail, his lawyer said Hamal was a member of the Nepalese royal family and disputed the charge.

The lawyer said Hamal said the sex was consensual and occurred after the delivery driver rang the doorbell twice and telephoned.

The door was ajar and Hamal went inside where he saw a man asleep on the lounge, but he could not wake him, the lawyer said.

Hamal then walked into a bedroom where the woman, 44, was asleep and when she eventually stirred, she took off some clothing and they had consensual sexual activity, the lawyer said.

But the crown's lawyer said the charge was of a serious sexual nature and further charges were likely.

She submitted Hamal was a flight risk, noting he was arrested at Sydney airport on Monday night with a one-way ticket to Bangkok.

The magistrate refused bail and adjourned the matter to Central Local Court on July 29.

A Sydney court has been told a man accused of raping a Sydney woman last weekend is a member of the Nepalese royal family.

Police say 21-year-old Amit Hamal walked into the bedroom at a Rose Bay home on Friday night when he went to drop off food.

He is a delivery driver for the Bayleaf Restaurant.

It is alleged he found the 44-year-old woman sleeping and raped her before running away.

Prosecutors told the court they will lay more charges, saying the offence happened while the victim's husband and children were in the house.

But the defence lawyer says the sex was consensual.

Hamal was arrested at Sydney airport last night, but his lawyer said he had a good reason for buying a one-way ticket overseas as he was heading home to see his sick father.

Hamal's wife was in court for the hearing.

The magistrate has refused bail.

The lawyer said Hamal, who is married, later telephoned the woman and returned to her house with his wife in the days after the incident "because he was feeling guilty about being unfaithful and wanted to apologise".

"He's either the most honest man in NSW, or the dumbest," the lawyer said. Hamal was refused bail and will appear in Central Local Court on July 29.

ah hamal has done nothing wrong in my opinion, the charges against him were all bull shit, the charges were to be filed against the woman who was not able to recognize his husband or someoneelse, a simple question, what will a male of any kind do is there is something naked in front of him? i surely think everybody will take chance of that, i might be wrong

I admire this Hamal guy's guts. The husband was sleeping in the couch while he screwed his wife. He should be thankful that he made out of that house alive.

The Aussies are way better off in apprehending this guy right from the airport, that was swift, unlike the American counterpart. In the court of justice, a woman will have more rights than a man when dealing with  rape charges. The odds are stacked heavily against him. Yes, we all Nepali beleive he's innocent just like we do always.
Now can somebody please bring up how crap Australian penal and judicial system is, and it is better in Nepal.
