During my stay in the states my passport got expired and I had to get new from DC. With the new passport I left Newark last month for Kathmandu. When I arrived in London I realized that the airport authority did not keep the I-94 which I had enclosed in the passport, and I could do nothing at that time.
Later I came to know that one has to submit I-94 form before leaving United States and for not doing so matter can be complicated at the port of entry. I did give them the form but the officials did not care that. Now I’m worried and i have no clue what should I do. Your suggestion will be very helpful for me. Thanks.

As far as my knowledge permits, it's the authority (the flight people where you get your boarding pass before leaving the US) that takes care of that. It was their job to take the I-94 off of your passport. So you shouldn't be in any problem as far as I understand.

dont worry ..it's not a big deal

i went home last December with my i-94 still attached in my passport, not knowing i had to give it to the official at the airlines....when i came back, the immigration officer didnt say a word about it ...and stapled the new one !

so, i think it will be same with you

Here's what you do:

Send the original I-94, original boarding pass, a copy of the next arrival stamp after you left US, copy of finger print record taken during departure.

Here's the format and the address where you should send. Failure to compny MAY result in disputable consequences.

Enclosed please find the I-94 in original and supporting documents as evidence of my departure from the United States. I entered the United States in XX status on XX XX, XXXX. I departed the United States on XXXX XX, XXXX.

Somehow, the airline person did not collect the original I-94 while I was departing the United States on XXXX XX, XXXX. I now request to submit the I-94 along with relevant documents to ensure that the departure is recorded correctly so that the applicant does not have any trouble reentering the United States in future.

Please find enclosed the following:

1. Form I-94, Arrival Departure Record in original;
2. Boarding pass in original;
3. Copy of the passport showing arrival stamp in XXXX;
4. Copy of fingerprint record taken at the time of my departure on XXXX XX, XXXX.

Your anticipated assistance in this matter is greatly appreciated.

Please confirm that the I-94 has been received and the departure recorded.

Thanks in advance for your assistance in this matter.

Can one travel outside of US while on OPT and in the process of applying for 140/485? If so, do they need to go back to Nepal to get the visa? Will appreciate any info, thanks.

Daniel,

If you have already filed I485 (aka AOS or Adjustment of Status) then you should not leave the US. Doing so will give cause to USCIS to presume that you have abandoned your intention to acquire Green Card.

If you have just filed I140 and not I485, then it should be ok for your to travel out of the US. Same goes with OPT.

Please clarify with your lawyer.
