 US Citizenship N-400 speeding ticket

Can anyone help me filling N-400....
in part 10 D. question numbers 15 to 18, what should I answer?

I got speeding tickets few years ago one I paid fine, one I went to traffic school.

15. Have you ever committed a crime or offense for which you were not arrested?
-> Yes No

16. Have you ever been arrested, cited or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason?
->Yes No

17. Have you ever been charged with committing any crime or offense?
-> Yes No

18. Have you ever been convicted of a crime or offense?
-> Yes No

Minor Traffic tickets are not considered major offense unless u received DWI/DUI, or any other offense for which you were detained. Minor traffic violations, parking tickets are not supposed to be answered YES in N-400. Read the handbook. That explains it pretty clearly. Hope it helps.

Getting speeding ticket is not a crime or an offense unless you were arrested for DWI. speeding tickets are only considered moving violation, so your answers for 15 - 18 should be NO.

here is what I found in one forum, and several are also saying that one must answer yes for speeding tickets.

In section about 'Good Moral Character' in the application, there is a section
about whether you were cited, stopped by law enforcement officer. If you get traffic
violation tickets, technically you got stopped by law enforcement officer, got cited
and potentially convicted. There is a big confusion among the community and even the
attorneys whether you are required to mention it in the application or not.

You should mention that in the application if they are serious tickets like
reckless driving, drunk driving etc.

You are not required to mention them in the
application if they are just simple ones like minor speeding, failure to stop etc.
If you have the proof that you paid for all those tickets (copies of cashed checks from the bank) or can get any certificate from local county court that you have paid all those tickets, you may want to mention them in the application just to make sure, and attach appropriate proof along with the
application. But if you can't provide them, don't break head
trying to get them if they are 5 to 10 years old.

you can answer yes and explain "one speading ticket" such and such date.

It will not disqualify you in anyway. It is best to put it down then don't worry about it.

Word of advise, don't refer to sites other than official USCIS site. You never know what kind of information you are getting. The information on these sites as good as the person posting it....USCIS.GOV is the official site. I close friend recently filed N-400, and he answered NO to traffic tkts (mind you, only speeding tkts - no major offense such as DWI/DUI or no detention by police of any kind). He already got his fingerprints done, and is scheduled for Civic Tests.......

Don't you worry.....

Thanks guys, That was just speeding ticket, no DWI/DUI or no detention. Paid fine by mail, so I guess I should not mention it in the N-400.

KnightCrawler, do you have any idea how long it took to get his fingerprints apointment?

I think It came back in 3 weeks time after filing the initial N-400...

Also, it depends I guess where your Service Center is, and how busy there are......BTW, where are you filing at? For eg..Texas, Vermont???..

I am filing at Texas service center. But I have not been here exactly 5 years, about 90 days to 5 years. Will that make any difference?

And do I need to put N/A in each and every field which I do not have answer (like in spouse name field if I am single)?

Yes, and Yes...

You can file 90 days in advance. Do not leave blank spaces...For eg. If you don't have middle name, say NA, same with Spouses/Children info.....My friend did the same under almost every blank fields.....I think the N-400 Booklet says to put in NA as well. Use the PDF form on the www.uscis.gov website. You can save it and update the information later as well.

Just curious, what kind of things does it hurt or will not reject you from getting greencad, as long as you properly disclose. Say wass wrong wih traffic offense as long as you disclose them?. Even if it is DWI or what not? I thought is its only when you are convicted of something that falls under exclusion clause..Just wondering? there is no way to measure my blood alcohol level because if i worry about it too much, i better not drink, right? when i go to restaurants and watch football, how would you even cheer for a team if yo dont have a beer or two, or when you are invited family dinners, ofcourse, i drink a beer or drink a glass of wine. i dont know if that would be above the limit or not. possibly not but what if ever it become a bit higher and got arersted. That means, you better be a water guy while you wait to apply for perm?
may be thinking too much ..ha ha
