My Employer is filing PERM for me. But I think my Employer screwed this up because in the qualification it asked for Bachelor's degree only. If this is the qualification that is required, then there will be thousands of applications. Is my case a gone-case now? Will my PERM be declined? Or do you think if my Employer can reject all the applicants with some specific reasons? But based upon what criteria can it reject other applicants? Kattie

Hi Slash, Thanks for responding. My employer put the job adv, but put the requirements as Bachelor's degree only. But now, with that as the minimum requirement, there will be thousands of applications. So will my PERM be in trouble if there are thousands of applications? Or do you think that my Company can do something that it will prove DOL that I am the right person and other applicants are not suitable (although the only requirement asked in advertisement was a bachelor's degree)??? I put the three job ads with a bachelor's degree plus more than five years of requirement for the EB2 category; thus far, I have received none.

If that is how your employer advertised as the ONLY criteria for job applicants, then he/she is in breach of the Equal Opportunities policy/law. It would greatly help if you could scan and post this particular job advertisement here, so that people can provide an informed answer to your query.

eb2 or eb3? if eb2 u r screwed. Rerun the ad. make sure ur employer is ready to pay eb2 salary.

EB 2 requires 5 years of experience with bachelors. Find O Net code for the job description you have and check if it passes for EB 2.
